These Terms of Use (“Terms”) govern your access to and use of Plantiary (the “App”) and related websites, content, and services operated by Blacke Teknoloji Sanayi ve Ticaret Limited Şirketi (“Plantiary,” “we,” “us,” or “our”). By accessing or using the App, you agree to these Terms. If you do not agree, do not use the App. Certain terms from our prior Terms (cookies, intellectual property/license, subscriptions/trials, disclaimers) remain in force and are restated herein for clarity.
You must be at least 13 years old (or the minimum digital consent age in your jurisdiction) to use the App. Users under 18 should use the App under the supervision of a parent/guardian.
You are responsible for all activity on your account and for keeping your credentials confidential. Notify us immediately of any unauthorized use or security breach.
Please review our Privacy Policy to understand how we collect, use, and share information. Your use of the App constitutes consent to our privacy practices.
We use cookies to operate and enhance the App. Some partners/affiliates may also use cookies. By using the App, you consent to our use of cookies as described in our Privacy Policy.
Unless otherwise stated, Plantiary and/or its licensors own the intellectual property rights to the App and its materials. You are granted a limited, personal, non-exclusive, non-transferable license to access and use the App for lawful, personal purposes, subject to these Terms. You may not republish, sell, rent, sub-license, reproduce, duplicate, copy, or redistribute App materials except as expressly permitted by us.
We operate a zero-tolerance policy for illegal, abusive, or otherwise objectionable content and behavior. Violations may lead to immediate content removal and account suspension or termination without notice.
Objectionable content includes, without limitation:
You are solely responsible for content you post and its consequences. You represent that you own or have the necessary rights to your content and that it complies with law and these Terms.
By submitting content, you grant Plantiary a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, process, display, reproduce, adapt, and distribute your content to operate, improve, and moderate the App.
We may monitor, review, filter, restrict, refuse, or remove content using automated tools (e.g., keyword/link checks, image classification) and human review, and we may suspend/terminate accounts that violate these Terms or the law.
Every UGC item provides an in-app Report option to flag objectionable content. You may also report via [[email protected]] or through the in-app help form with a link/screenshot and reason.
We review good-faith reports of objectionable content within 24 hours and, where appropriate, remove the content and suspend/eject the offending user. Urgent-risk cases (child safety, credible threats) may result in immediate account freezing and notification to law enforcement.
Repeated or severe violations may lead to permanent bans and identifier-level restrictions where lawful. If your content is removed or your account restricted, you may appeal via [[email protected]] (include username, content link/ID, and rationale). We may preserve reports/logs for a reasonable time to document violations and comply with legal duties.
Note: The UGC rules above supplement existing “Comments/Content” provisions and clarify that Plantiary may monitor and remove content at its discretion for safety and compliance.
Subscriptions begin when payment is confirmed and continue for the selected period (e.g., weekly, monthly, yearly, lifetime). Auto-renew occurs unless you cancel before the current period ends via your store account (App Store/Google Play/Huawei). Pricing may change and will apply at the next renewal. Trial offers may require payment details and convert to paid on the first day after the trial unless you cancel beforehand. Subscription offers may be shown in the app (full screen, in-app message, notification) and are not mandatory; free use remains available with limited features. Features, services, and pricing for subscription tiers may be updated from time to time.
To help resolve refund requests, you consent to our sharing—with Apple—data regarding your access to purchased content/features, strictly as necessary to process such requests and in line with Apple policies.
You agree not to (a) use the App for any unlawful purpose; (b) attempt to gain unauthorized access to the App or other accounts; (c) interfere with or disrupt the App; (d) use any automated means to access the App in ways that burden or disrupt it; (e) reverse engineer the App except as permitted by law; (f) misuse reporting tools or submit fraudulent reports.
The App may contain links to third-party sites or services. We are not responsible for their content, policies, or practices. You access them at your own risk.
To the maximum extent permitted by law, we disclaim all representations, warranties, and conditions relating to the App and its use. Nothing here limits/excludes liability where such limitation/exclusion is unlawful (e.g., death/personal injury from negligence; fraud). As long as the App and information are provided free of charge, we are not liable for any loss or damage of any nature.
Subject to applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits/revenues, arising from your use of the App, even if we have been advised of the possibility of such damages.
You agree to defend, indemnify, and hold harmless Plantiary and our affiliates, officers, employees, and agents from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the App, or your violation of these Terms or law.
We may update or modify the App and these Terms from time to time. We will provide in-app notice of material changes. Continued use after changes means you accept the updated Terms.
