These Terms of Use (“Terms”) govern your access to and use of Plantiary (the “App”) and related websites, content, and services operated by Blacke Teknoloji Sanayi ve Ticaret Limited Şirketi (“Plantiary,” “we,” “us,” or “our”), located at Pazarsuyu Köyü 2. OSB Mevkii 4. Cadde No: 5 Bulancak / Giresun, Türkiye.
By accessing, downloading, or using the App, you confirm that you agree to these Terms and are bound by them. If you do not agree to these Terms, please do not use the Plantiary App or Services.
1. Definitions
- App/Service: The Plantiary mobile application, website, and all related services provided by us.
- You: The person or entity using the App or Service.
- UGC: User-Generated Content.
2. Who May Use the App
You must be at least 13 years old (or the minimum digital consent age in your jurisdiction) to use the App. Users under 18 should use the App strictly under the supervision of a parent or legal guardian.
3. Accounts, Security, and Data Deletion
- 3.1 Account Responsibilities: You are responsible for all activity on your account and for keeping your credentials confidential. Notify us immediately of any unauthorized use or security breach.
- 3.2 Account Deletion & Data Removal Policy: You have the right to delete your account within the mobile app. This deletion operation encompasses the permanent removal of all associated data, including but not limited to plant identification history, saved plants, and purchase history. By initiating the account deletion process, you acknowledge and consent to the erasure of your personally identifiable information and usage data from our systems. This action is irreversible.
4. Privacy, Cookies, and Analytics
Please review our Privacy Policy to understand how we collect, use, and share information. Your use of the App constitutes consent to our privacy practices.
- Cookies: We use cookies to operate and enhance the App. By using the App, you consent to our use of cookies as described in our Privacy Policy.
- Analytics: We may use third-party tracking tools to better understand user behavior, interactions, and to improve our overall user experience. This data is collected solely for analytics purposes.
5. Intellectual Property & License to Use the App
Unless otherwise stated, Plantiary and/or its licensors own the intellectual property rights to the App and its materials.
- License: We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly for lawful, personal purposes.
- Restrictions: You agree not to: (a) License, sell, rent, lease, assign, distribute, or commercially exploit the App; (b) Modify, make derivative works of, disassemble, decrypt, or reverse engineer any part of the App; (c) Remove or alter any proprietary notice or copyright from Plantiary.
- 6.1 Zero-Tolerance for Objectionable Content: We operate a zero-tolerance policy for illegal, abusive, or otherwise objectionable content. Violations may lead to immediate content removal and account termination without notice. Objectionable content includes, but is not limited to: Hate speech, harassment, nudity, promotion of self-harm, illegal activities, and dangerous plant/medical claims presented as instructions.
- 6.2 Your Responsibilities: You are solely responsible for the content you post. You represent that you own the rights to your content and that it complies with the law.
- 6.3 License You Grant to Us: By submitting content, you grant Plantiary a worldwide, non-exclusive, royalty-free, transferable license to host, display, reproduce, and distribute your content to operate and improve the App.
- 6.4 Moderation & Proactive Filtering: We may monitor, review, filter, or remove content using automated tools and human review.
- 6.5 Report Mechanism & 24-Hour Action: Every UGC item provides an in-app "Report" option. We review good-faith reports within 24 hours and, where appropriate, remove the content and suspend the offending user. Urgent-risk cases may be reported to law enforcement.
- 6.6 Your Suggestions: Any feedback, comments, ideas, or suggestions provided by you to Plantiary remain the sole property of Plantiary. We are free to use them without any credit or compensation to you.
7. AI Technology & Medical/Botanical Disclaimer (IMPORTANT)
The App uses artificial intelligence technologies for plant, insect, and mushroom identification. AI-generated outputs may be inaccurate or incomplete.
- Users should independently verify information and MUST NOT rely on such outputs as professional, business, legal, agricultural, or medical advice.
- Do not rely on the App to determine if a plant or mushroom is safe to consume, touch, or use for medicinal purposes. Plantiary will not be responsible for any outcome, injury, or damages that may occur during the course of using our resources.
8. Subscriptions, Trials, Payments & Refunds
- 8.1 Billing: Subscriptions begin when payment is confirmed and auto-renew unless canceled before the current period ends via your app store settings (App Store / Google Play / Huawei).
- 8.2 Return and Refund Policy: Due to the nature of digital content, refunds are generally not available once access has begun unless required by consumer protection laws. For purchases made through digital distribution platforms (Apple App Store, Google Play), the refund policies of those respective platforms apply.
- 8.3 Apple Data Consent: To help resolve refund requests, you consent to our sharing—with Apple—data regarding your access to purchased content, strictly to process such requests.
9. App Updates, Modifications & Third-Party Services
- Updates: Plantiary may provide enhancements, bug fixes, or updates. We reserve the right to modify, suspend, or discontinue any feature with or without notice. We have no obligation to provide any specific updates.
- Third-Party Links: The App may contain links to third-party sites. We are not responsible for their content or practices. You access them entirely at your own risk.
10. Prohibited Uses
You agree not to: (a) Use the App for unlawful purposes; (b) Attempt to gain unauthorized access; (c) Interfere with or disrupt the App using automated means; (d) Misuse reporting tools or submit fraudulent reports.
- Promotions: We may host contests or sweepstakes. These will be governed by separate rules, and you are responsible for reading those rules.
- Typographical Errors: If a premium service is listed at an incorrect price due to a typographical error, we have the right to refuse or cancel any orders placed at the incorrect price and will issue a refund if you were already charged.
12. Copyright Infringement Notice
If you are a copyright owner and believe any material on our App infringes your copyright, please contact us with: (a) A physical or electronic signature; (b) Identification of the infringing material; (c) Your contact info; (d) A statement of good faith belief; and (e) A statement under penalty of perjury that you are authorized to act on behalf of the owner.
13. No Warranties & Limitation of Liability
- No Warranties: The App is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. Plantiary expressly disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the App will be uninterrupted, error-free, or fully accurate.
- Limitation of Liability: To the maximum extent permitted by applicable law, Plantiary shall not be liable for any special, incidental, indirect, consequential, or punitive damages (including loss of profits, data, or personal injury) arising out of the use or inability to use the App. Our maximum entire liability to you shall be limited to the amount actually paid by you for the App.
14. Indemnification
You agree to indemnify and hold harmless Plantiary, its affiliates, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the App, your UGC, or your violation of these Terms.
15. Term and Termination
These Terms remain in effect until terminated by you or Plantiary. We may, at our sole discretion, suspend or terminate your account and access to the App at any time, with or without notice, if you violate these Terms.
16. Governing Law & Severability
- Governing Law: These Terms are governed by the laws of Türkiye, without regard to its conflict of law principles.
- Severability: If any provision of these Terms is deemed invalid or unenforceable, that provision will be modified to the greatest extent possible to achieve its intent, and the remaining provisions will remain in full force and effect.
17. Changes to the Terms
We may update or modify these Terms from time to time. If a revision is material, we will provide notice (e.g., in-app notification). By continuing to access or use the App after any revisions become effective, you agree to be bound by the updated Terms.
